ITIN – Individual Taxpayer Identification Number – is a tax processing number issued by the Internal Revenue Services (IRS) to individuals who are required to have a U.S. taxpayer identification number but do not have and are not eligible to obtain a SSN (Social Security Number)
IRS issues ITINs to the individuals regardless of their immigration status, because both resident and non-resident aliens may have U.S. tax filing and/or reporting requirements under the Internal revenue Code.
ITIN helps individual comply with the U.S. tax laws and does NOT authorize work in the U.S., provide eligibility for the Social Security benefits or qualify a dependent for Earned Income Tax Credit benefits.
When you have to apply for ITIN if:
You are a non-resident alien who is required to file tax return
You are a resident alien who met the “substantial presence’ test and file tax return
You are dependent or spouse of a U.S. citizen/resident alien
You are dependent or spouse of a non-resident visa holder
You are a non-resident claiming Tax Treaty benefit
You are non-resident student, professor or researcher filing tax return or claiming an exception
You are a non-US representative of a foreign corporation which is subject to e-filing requirements
You are foreign person with a home mortgage loan located in the U.S.
You are foreign buyer of the U.S. real property disposed by foreign seller
You are non-resident having gambling winning
You are foreign person receiving Scholarships, Fellowships and Grants
You are foreign person having interest bearing bank account that generates income effectively connected with their U.S. trade or business
